Lovely Meds, Inc. — Terms of Use

These Terms of Use (“Terms”) govern your use of https://www.lovelymeds.com (the “Site”) and the products (“Products”) offered by Lovely Meds, Inc. (“Lovely Meds,” “we,” “us,” or “our”). Lovely Meds operates a technology platform that enables patients to order prescription products online. Lovely Meds is not a medical provider. Clinical evaluations and prescribing decisions are made independently by licensed healthcare providers affiliated with Beluga Health, P.A. and its affiliated medical groups (“Beluga Health Provider Group”).

By accessing or using the Site, you agree to these Terms, our Privacy Policy, and the Beluga Health Provider Group’s Notice of Privacy Practices. If you do not agree, you may not use the Site.

1. No Medical Advice from Lovely Meds

Lovely Meds does not provide medical advice, diagnosis, or treatment. All clinical decisions, including prescriptions, are made solely by independent licensed healthcare providers. Lovely Meds does not influence medical outcomes.

2. Not for Emergency Use

The Site is not intended for medical emergencies. If you are experiencing a medical emergency, call 911 immediately.

3. Prescription Policy

Prescription medications are dispensed only when a licensed provider determines that treatment is medically appropriate. There is no guarantee that a prescription will be issued. Controlled substances are not prescribed.

Note: U.S. law requires a prescriber review before any prescription product can be dispensed. This review is included automatically as part of the order process and is not a separately billed service.

4. Geographic Availability

Products are only available in U.S. states where Beluga Health Provider Group is authorized to operate. Accessing or attempting to use the Site from outside the United States, including the United Kingdom, is prohibited.

5. Orders and Payments

All orders are processed as one-time purchases.
Prices, product availability, and shipping timelines are subject to change without notice.
All orders may be subject to prescriber and compliance review before final approval.

6. Refund & Cancellation Policy

Due to FDA regulations and the Drug Supply Chain Security Act (DSCSA), once a prescription is issued and the medication has been prepared and labeled for dispensing, it cannot be canceled, refunded, or returned, even if not yet shipped. This policy protects medication integrity and patient safety.

a. Cancellation Before Prescriber Review
If you cancel your order before a provider review begins, a $40 administrative fee will apply.

b. Cancellation After Prescriber Review (Before Pharmacy Dispatch)
If your order has already undergone prescriber review, but medication has not yet been dispatched, a $40 administrative fee will apply.
Once a prescription is finalized and sent to the pharmacy, the order is final and cannot be canceled.

c. After Dispatch – No Refund or Return
After the pharmacy has labeled and shipped your medication, no cancellations, returns, or refunds are permitted. In the event of shipping damage or defect, we may issue a replacement only.

d. Bulk Purchase / Multi-Pack Refunds
If you purchase a multi-pack of treatment supplies at a discounted bulk rate and later decide not to use the remaining packs:

You may request a refund for unopened, unused packs before they are shipped.
Refunds will be recalculated based on the standard single-pack price for any packs already shipped or used.
A 10% administrative fee will be deducted from the refundable balance.
Example: If you buy a 6-pack at a discounted rate and request a refund after 2 shipments, the refund will equal:
(Total paid – [2 × single-pack rate]) – 10% admin fee.
Refunds will be issued within 15 U.S. business days.

7. Site Access and Security

You must be at least 18 years old to use the Site. You are responsible for safeguarding your account credentials and for all activity under your account.

8. Electronic Communications

By using the Site, you consent to receive communications electronically, including order updates, prescriber review notices, and confirmations.

9. Intellectual Property

All content, trademarks, and technology on this Site are the property of Lovely Meds or its partners. You may not copy, modify, or distribute any materials without prior written permission.

10. Disclaimers

The Site and Products are provided “as is.” Lovely Meds disclaims all warranties, including merchantability or fitness for a particular purpose. Lovely Meds is not liable for damages arising from your use of the platform or third-party medical services.

11. Dispute Resolution and Arbitration

All disputes shall be resolved exclusively through binding arbitration in the United States under the rules of the American Arbitration Association. By agreeing to these Terms, you waive the right to a jury trial or class action.

12. Governing Law

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal regulations. Lovely Meds operates solely under U.S. law and is not subject to UK, NHS, or MHRA/GPhC standards.

13. Policy Changes

We may update these Terms at any time. Continued use of the Site constitutes acceptance of any updated Terms.

14. Medication Disposal

Dispose of unused or expired medications responsibly. Use authorized DEA drug disposal locations or mix with an undesirable substance (e.g., cat litter) in a sealed container before disposal.
