These Terms of Use ("Terms") govern your use of https://www.lovelymeds.com (the “Site”) and the services ("Services") and products ("Products") offered by Lovely Meds, Inc. (“Lovely Meds,” “we,” “us,” or “our”). We work with Beluga Health, P.A. and its affiliated medical groups (“Beluga Health Provider Group”) to provide access to licensed healthcare providers (“Providers”). All clinical services are provided solely by licensed Providers. Lovely Meds provides the non-clinical technology platform, customer service, and pharmacy coordination.

By accessing or using the Site, you agree to these Terms, our Privacy Policy, and the Beluga Health Provider Group’s Notice of Privacy Practices. If you do not agree, please do not use this Site.

1. No Medical Advice from Lovely Meds

Lovely Meds is not a medical provider and does not offer clinical advice. Diagnosis, treatments, and prescribing decisions are made solely by independent licensed Providers. Lovely Meds does not influence clinical outcomes.

2. Not for Emergency Use

This platform must not be used for medical emergencies. If you are experiencing a medical emergency, call 911 immediately.

3. Prescription Policy

Prescriptions are only issued when deemed medically appropriate by a licensed Provider. There is no guarantee a prescription will be issued. Controlled substances are not prescribed. All patients must follow medication instructions and contact their Provider for any concerns.

4. Geographic Availability

Services are only available in U.S. states where Beluga Health Provider Group is authorized to operate. Accessing the platform from jurisdictions outside the United States, including the United Kingdom, is prohibited.

5. Orders and Payments

All purchases are processed as one-time transactions. We do not offer subscriptions or recurring billing unless explicitly stated. Prices, availability, and shipping timelines are subject to change without notice. Orders may be subject to medical and compliance review before being approved.

6. Refund & Cancellation Policy

Due to FDA regulations and the Drug Supply Chain Security Act (DSCSA), once a prescription is issued and the medication has been prepared and labeled for dispensing, it cannot be canceled, refunded, or returned, even if not yet shipped. This policy ensures medication integrity and patient safety.

a. Cancellations Before Provider Allocation:

  • If you cancel your order before a Provider is assigned, a $40 administrative fee will be charged.

b. Cancellations After Provider Review (Before Medication Dispatch):

  • If a consultation has been completed (with or without a prescription issued), but before the pharmacy dispatches the medication, a $40 administrative fee will still apply.

  • Once a prescription is issued and sent to the pharmacy, the order is final and cannot be canceled.

c. After Dispatch – No Refund or Return:

  • Once the pharmacy has labeled and dispatched your medication, no changes, refunds, or returns can be accepted.

  • In cases of delivery damage or defect, we may offer a replacement only, not a refund.

d. Multi-Month Prepaid :

If you prepay for multiple months at a discounted rate:

  • You may cancel before the next scheduled shipment, with a refund of the unused portion.

  • However, refunds will be recalculated using the non-discounted rate for the months you already received, and a 10% administrative fee will be deducted from the remaining balance.

Example:
If you prepaid for a 6-month with quarterly shipments and cancel during the second shipment period, we will:

  • Calculate the cost of months received at the lower-tier rate (e.g., monthly or 3-month pricing).

  • Deduct that amount from the total you paid.

  • Apply a 10% admin fee to the remaining amount.

  • Refund the rest to your card within 15 U.S. business days.

Refunds will not be issued proportionally across the full term, as the multi-month discount was already applied and partially utilized.

7. Site Access and Security

You must be at least 18 years old to use the Site. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

8. Electronic Communications

By using the Site, you agree to receive communications from us electronically, including consultation updates, health-related content, and order confirmations.

9. Intellectual Property

All content, trademarks, and technology on this Site are the property of Lovely Meds or its partners. You may not copy, modify, or distribute any materials without prior written permission.

10. Disclaimers

The Site and its Services are provided “as is.” Lovely Meds disclaims all warranties, including merchantability or fitness for a particular purpose. We are not liable for damages resulting from use of our platform or third-party medical services.

11. Dispute Resolution and Arbitration

All disputes will be resolved exclusively through binding arbitration in the United States, under the rules of the American Arbitration Association. By agreeing to these Terms, you waive any right to a jury trial or class action.

12. Governing Law

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal regulations. Lovely Meds is not subject to UK law, NHS standards, or MHRA/GPhC guidelines. We are a U.S.-only service.

13. Policy Changes

We reserve the right to update these Terms at any time. Continued use of the Site constitutes acceptance of any updates.

14. Medication Disposal

Dispose of unused or expired medications safely. Use authorized DEA drug disposal sites or mix with an undesirable substance (like cat litter) in a sealed container before throwing away.
